A disability lawyer or non attorney representative is entitled to receive a fixed percentage of a disability claimant's back pay. Currently, a representative can receive twenty-five percent of a social security disability or SSI disability claimant's backpayment (up to a designated maximum amount, which may periodically change).

And, typically, if a disability claim has been won, the representative will receive this fee for representation before the claimant receives his or her backpay.
