This information may help claimants with representation, as well as claimants who are not represented by an attorney or non attorney representative. Understanding how the Social Security Disability system works can make the difference between winning or not winning the continuing disability benefits and backpay to which a person is entitled. In pursuing a claim for ongoing and past due benefits, claimants should learn about the disability process to improve their chances of winning. |

Why is the disability process so long? We've already touched on this issue but on this page we'll be a little more focused. Why is the process so terribly long and why does it have to be this way? That's a question asked everyday, literally by many thousands of people. There are a couple of answers. For one, obviously, disability cases are a serious matter. And that's exactly how the social security administration views them. It's for that reason that, if your medical records even mention the slightest hint of depression (even if you are applying for disability based on back pain), the disability examiner will be OBLIGATED to hunt down more information to see if maybe, just maybe you have any chance of being approved based on depression. So, on one hand, the program attempts to be as fair to claimants as possible. The consequence of this, however, is that case processing time suffers considerably as a result of this thoroughness, making the entire disability process much longer than it would otherwise be. But there's another reason why disability takes so long and it's not a pleasant answer. There are, unfortunately, very many "doubtful" claims making their way through the social security system. This is an allegation that few people would dispute. I, myself, have seen people apply for disability based on heatlh complaints like wrist pain, ankle swelling, and even PREGNANCY. Do disability examiners get to weed out these frivolous claims? No. They are required by law to give every case every benefit of the doubt. The consequence of having to fully examine every one of these types of claims almost guarantees that the wait for every other disability claimant will be long and unpleasant. This is the reality regarding the social security disability system: a ton of frivolous cases which social security MUST give fair treatment to makes the wait LONG for every person who has a qualified and deserving case---and who is probably having severe financial problems as a result of their medical condition and inability to work.
