BE APPEALED - TIPS FOR A DISABILITY RECONSIDERATION APPEAL





Here's a fairly common question that is asked by individuals who have been denied for disability after filing a disability application.

"I applied for SSD and got a letter informing me that I am not disabled and not eligible to receive benefits. Can this decision be appealed?

The answer, of course, is yes, this denial for disability benefits can be appealed and should be appealed immediately. Here is a tips list for filing the first disability appeal that is available to claimants who have been denied.

1. Contact the social security office and request an appeal. This appeal will be a "request for reconsideration".

2. After the forms have been received, complete and return them within sixty days. You have sixty days to file the request for reconsideration, but don't wait a single day longer than you have to. Instead, send in the appeal as soon as possible.

3. Make a copy of what you mail to the social security administration for your personal records.

4. 1-2 weeks after sending in your appeal, call the social security office to verify that it was appealed. If they have no record of having received it, make another copy of the copy you have and mail it in again. And, once again, make a followup call after you mail it.

5. If you have a disability attorney, get the attorney to complete the reconsideration appeal for you and make sure that the attorney sends you a dated copy of what they submitted to the social security office.

6. If you don't have a disability lawyer working on your case, consider getting one as approximately 85% of all disability reconsiderations are also denied.
