MISSED DEADLINE TO APPEAL SSD DISABILITY - WHAT TO DO





If you're ever denied on an ssd (social security disability) or ssi disability claim, you'll have 60 days in which to file the appropriate appeal paperwork. And, though the social security administration does not go out of its way to inform you of this, you'll actually have 65 days since SSA will allow you an extra five days for mailing time.

This definitely sounds like a reasonable length of time in which to file an ssd appeal, but, despite this, a large number of disability applicants miss their appeal deadline. In some instances, this is due to procrastination on their part, but in others it is due to reasons beyond their control. For instance, they may have a problem with their mail, they may be experiencing mental confusion or memory lapses (which can certainly be the case for a disability claimant who has depression, a head injury, or has suffered a stroke), or...the social security may simply not have mailed the denial letter (ssa will always deny this, but since it happens so frequently, one has to seriously wonder).



If you miss your deadline to file your ssd disability appeal, and have a reason for missing this deadline (that would sound reasonble and legitimate to a claims rep at the social security office), then contact the social security office and inform them that you still wish to file your appeal. Also inform them that you wish to request GOOD CAUSE for sending in your appeal late.

Note: if you submitted an appeal but the social security office is adamant that they never received the appeal, you may be in the position of requesting good cause for filing a late appeal also.
