It may not be a bad idea. Statistically, the vast majority of ssdi disability claims are denied at the initial claim level. Those claimants who are denied on an application for benefits may, depending on the state in which they live, file either a request for reconsideration, or a request for hearing before an administrative law judge. If a request for reconsideration is filed (in those states for which the recon stage is still conducted), this will, mostly likely, lead to the filing of a request for hearing----simply because the vast majority of reconsiderations are also denied (the denial rate is actually higher for reconsiderations than initial claims). Therefore a social security or ssi disability claimant should definitely consider obtaining representation if their application for benefits is denied and, statistically, in many cases, it isn't a bad idea to do this prior to being denied simply to prepare in advance.
