General information regarding workers compensation claims:
Workers compensation is set up to protect workers in the event they become hurt on the job or develop a sickness that is somehow related to their job. Essentially, the system works like this: when a worker becomes injured, rather than sue their employer, they can file a claim for workers compensation benefits.
The advantages to this benefit system are not without a certain amount of significance. Instead of initiating costly litigation (which around the turn of the century was the only option available to injured workers), an employee can instead file a claim that can provide for the following outcomes:
- Protection of a worker's job (an employer cannot terminate an employee simply because they are injured, nor can an employer take any action against someone because they have filed a workman's comp claim).
- Continued payment of a percentage of the worker's pay while the worker is injured.
- Payment of all medical expenses related to a worker's job accident or job-related illness (usually including the cost of emergency care, necessary surgery, and rehabilitative services).
