DISABILITY DECISION - WHAT HAPPENS IF YOU WIN OR LOSE ?





If you have received a denial notice from Social Security, you will have to decide if you wish to appeal the denial. If you decide to appeal your initial disability claim, you need to file a reconsideration appeal within sixty-five days of the date of the denial notice. Once you have filed your reconsideration, it will be sent back to the state disability agency for another medical determination. If your reconsideration is denied, you may still file a request for hearing appeal within sixty-five days.

The request for hearing involves a hearing before an administrative law judge. The administrative law judge may be more subjective in making a determination that an individual is disabled under the rules and regulation governing Social Security disability. Consequently, if you were not allowed at the initial level it is likely that you will not receive an allowance until the administrative law judge hearing.

Statistically, only about sixteen percent of reconsiderations are an allowance. If you receive a notice that your disability decision is an allowance, you will receive a Social Security or Supplemental Security Income benefit.

If you receive an allowance for Social Security disability at an administrative law judge hearing, your claim will be sent to a payment center to be processed. Sometimes the payment center is slow to get individuals into pay status due to a variety of reasons.

Additionally, if you are entitled to SSI the hearing decision will be sent to your local Social Security office, and another interview will have to be done before you go into pay.
