Individuals applying for Supplemental Security Income disability (SSI) must go through the same disability process as individuals who apply for Social Security disability. All SSI claims are sent to a state disability agency for a medical decision. However, in addition to meeting the medical criteria for Social Security disability, individuals who have applied for SSI must also meet income and resource requirements. What do I mean by income and resource requirements? For SSI purposes a resource might be any of the following life insurance policies with cash value, vehicles, land or homes other than where you live, bank accounts, investments, trust funds, etc. If any of these are above the current resource limits (the 2007 resource limit is 2000 for individuals and 3000 for couples), the SSI claim will be denied. Additionally, SSI has income limits, which may cause an individual’s SSI claim to be denied. Keep in mind; SSI is a need-based program. Consequently, an individual may be a medical approval for SSI and be denied to receive a disability benefit due to income and resources. So, who usually wins SSI benefits? Individuals who have resources and income below SSI limits usually “win” SSI disability benefits providing they have met the medical criteria for Social Security disability.
