You may file a disability claim with Social Security if you have been unable to work due to a medical and/or mental condition for twelve months or you expect that you will not be able to work for twelve months. If you are still working, but you are working fewer hours and earning under the Social Security substantial work activity amount, then you may still be able to file a disability claim with Social Security. You can begin the disability claim process with Social Security by filing an application, and once Social Security has received you disability claim it will be forwarded to the state disability agency for a medical decision. The state disability agency considers your medical and/or mental impairments, your work history, education, and age when making a decision on your Social Security disability claim. Generally, you will receive a decision on your initial disability claim in about ninety days, although some cases take less than ninety days while others take more time.
