Should you get a lawyer for an SSI disability case? This is to some extent a subjective issue and a judgement call. If you have a pending SSI disability case and your next step is either to appear at a disability hearing, or to file a request for a disability hearing, then you would be advised by nearly anyone familiar with the federal disability system (including disability lawyers, social security claims reps, disability examiners, and even disability judges) to get representation to assist you with your case. Your representative can be a non-attorney claimant's advocate or a social security disability attorney, as long as the individual you choose has an in-depth knowledge of the social security administration's disability appeal system. If your SSI or social security disability case is not at the hearing level yet, getting a lawyer is more of a judgement call. The truth is, for some claimants there may be no actual need to find a disability lawyer. And even with representation, it is very unlikely that an individual will be approved for disability at the reconsideration or review stage (the appeal stage that comes prior to the social security disability hearing). However, since most reconsiderations are denied and the next logical step is to request a disability hearing, most claimants would not be unwise to get representation at an earlier point in the process. For many claimants, in fact, finding a lawyer sooner, rather than later, can take off some of the stress associated with applying for disability. And there are also some practical benefits that come with retaining a disability lawyer. 1. A disability lawyer will file your appeal paperwork for you. 2. A disability lawyer will make periodic status checks on your pending claim. 3. A disability lawyer may shield you by only allowing social security to obtain information from your lawyer's office rather than attempting to obtain it directly from you. 4. A disability lawyer can examine the basis for your prior denials to see if your claim was properly decided by the social security administration. 5. A disability lawyer will receive copies of all correspondence that the social security administration sends to you, ensuring that deadlines are not missed, and that official inquiries for information are properly responded to.
