SOCIAL SECURITY DISABILITY, SSI - WILL I HAVE TO GO TO A HEARING ?





If you file an application for social security disability (aka ssd, ssdi) or ssi disability, the chances are great that your claim will be turned down at the basic application level (the statistics vary by state, but, for the most part, only about 15-20 percent of initial ssd or ssi disability applications are approved).

With this being the unfortunate reality facing applicants who file for disability benefits, the best option available to those whose claims are denied will be to follow the appeals process and get their case heard by a judge at a hearing.

Hearings are best prepared for when a social security disability or ssi disability applicant is represented by an experienced lawyer. However, even when a disability attorney is actively involved in a claimant's case (filing appeals, gathering medical records, obtaining detailed statements from an applicants doctors, etc), this does not negate the fact that a claimant will still have to be present on the day of their hearing.

It's no mystery to disability attorneys that federal social security judges take a dim view of claimants who file hearing requests...and then do not show up for hearings. Of course, if a claimant misses a scheduled hearing appointment but can provide a solid rationale for not attending, most administrative law judges will react reasonably and reschedule a claimant's hearing date.
