Yes, you do get another disability appeal if your claim is denied at any stage in the disability appeal process prior to filing a civil action in federal district court. Federal court is essentially the end of the line in the appeals process and a claimant who is denied at this level will only have the option of filing a brand new claim. In almost every case, of course, anytime an applicant for social security disability or ssi disability benefits is denied on a claim, the best course of action will be file the next appropriate appeal. And in the majority of cases, also, the ultimate goal for a claimant who has been denied will be to seek a disability hearing before an administrative law judge. Unfortunately, this step in the disability appeal process is particularly daunting, though not for the reasons one might think. The approval chances following an ALJ hearing are actually quite favorable (on average, more than half of all ssd and ssi claims that are heard by administrative law judges are approved following a hearing). What is daunting about this appeal step is how long it takes to get a hearing after one has been requested. Depending on where a claimant resides (which determines which hearing office will handle their claim), and how backlogged their hearing office is, it may take well over a year to get a hearing appointment. And in many parts of the country, the wait may be as long as a year and a half to two years. Can the wait for a hearing be minimized in any way? Generally not. However, claimants who are represented can ask their attorney to investigate the possibility of having their claim reviewed prior to a hearing. This is known as an "on the record review". And, in some instances, an on the record review will result in a favorable on the record decision. If, however, an on-the-record review does not result in an approval of benefits, a claimant will still be afforded the opportunity to have a hearing which they may attend unrepresented or with a disability attorney.
