If you learn at some point that the social security office issued a denial on your social security disability or ssi disability claim more than 60 days prior, yet you did not receive a denial letter, you will be in the position of being out of your appeal period. What is the appeal period? Basically, regardless of the level your claim is at, anytime you receive a denial of your claim for ssd or ssi benefits, you will be given 60 days in which to submit the appropriate appeal. However, if you fail to submit the necessary appeal paperwork within the allowable time limit, you may still file an appeal---provided that you can show good cause for filing your appeal late. To request good cause on a late appeal, you simply need to send your appeal (granted, this may be the second appeal that you actually submit) to the social security office along with a sufficiently detailed letter explaining why your appeal is being submitted late (this is your good cause statement). Reasons for good cause for a late filing may include: illness, mail problems, mental incompetency, or any other reason that could be construed as rational and reasonable.
