SOCIAL SECURITY DISABILITY OVERVIEW, Pt II, STAGE 4




Part 2 of this Overview on Social Security disability should fill in gaps and answer questions you may have thought of after reading Part 1. After completing Part 2, read the Questions, Tips, and Advice that may help you with your Social Security or SSI claim for disability, and possibly improve your chances of winning the benefits to which you are entitled.

STAGE FOUR


At some point, however, a decision letter will arrive.

If the Notice of Decision is favorable (either fully or partially), then the Claimant has won the case. Several weeks after the decision letter, a Notice of Award will be sent from the social security office explaining:

1. how much the claimant will receive each month in disability benefits.
2. how much the claimant is owed in past due benefits.
3. when the benefits will start.

With each notice received, the Claimant should contact the representative immediately. This serves two purposes:
  1. It lets the Representative know that the Claimant has received their copy regarding the claim.
  2. It keeps everyone aware of what is happening on the disability claim, in the event that Social Security fails to notify the Representative with updated information.

If the Notice of Decision is unfavorable, then both the Representative and the Claimant must decide what to do next. Depending on the case, and its particulars, it may be decided that a new claim for disability should be filed, or a Request for Review of the judge's decision should be filed .

However, in most cases where a Claimant is AGE 50 & OVER, this will not be necessary. This is because the social security rules that govern disability are most favorable for this age group.
