SOCIAL SECURITY DISABILITY OVERVIEW, Pt II, STAGE 2

Part 2 of this Overview on Social Security disability should fill in gaps and answer questions you may have thought of after reading Part 1. After completing Part 2, read the Questions, Tips, and Advice that may help you with your Social Security or SSI claim for disability, and possibly improve your chances of winning the benefits to which you are entitled.

STAGE TWO

According to the Social Security Administration, approximately 70 percent of all Social Security Disability & SSI claims for disability are denied at the Initial level.

Therefore, (ADVICE) claimants who get denied for disability benefits should not give up on their claims (it happens to almost everyone), but, instead, should request an appeal after their claims have been denied.

To request the first appeal, or Reconsideration, a claimant need only make a call to Social Security. After the call has been made, appeal forms will be sent out, and, after these have been returned, the claim will be transferred to DDS for a second evaluation of the claim.

How long does a Reconsideration take for a disability claim? As with an Initial case, there's really no way to know. Claims can take a month, or take several months.

How is a Reconsideration handled differently from an Initial Case? Not a bit. A reconsideration is handled exactly the same way, except by a different Social Security Examiner.

As with Initial disability Claims, (TIP) claim holders may try to assist themselves by:
  1. Calling the Examiner (this time, the Recon Examiner) to get periodic information updates, a.k.a. the bugging principle.
  2. By submitting to the Examiner the most recent medical evidence, especially if recent doctor or hospital visits have been made.

Unfortunately, the rate of denial on reconsiderations is even higher than on applications: over 80 percent of social security & SSI claims for disability at the reconsideration level are denied!

Should a Reconsideration denial be cause for alarm? Though it may sound strange to hear this---not really.

People who handle Disability claims for a living, myself included, know that most Reconsiderations will be denied. Very often, they tell their clients to expect this second turn-down, and to view the Recon as a required "hoop to jump through" before being permitted to go to the next appeal.

The next appeal for a disability claim, of course, is a hearing before a judge.
