Not everyone who files for Social security disability or SSI will also have to file for long term disability benefits. Unlike federal disability benefits, LTD benefits are derived from an employer-provided or employee-purchased insurance plan. And, of course, not every worker has LTD coverage.

However, because some disability claimants also have long term disability insurance coverage, they will learn that the nature of filing for an LTD claim is markedly different than filing for SSD (most long term disability plans will require that an individual also file for SSD).

How do the two situations differ? The differences between social security disability and long term disability (LTD) literally abound, but they can be effectively boiled down into two noteworthy categories.
  1. When you file for long term disability benefits, the person adjudicating (deciding) your claim is not impartial.

  2. It can be very difficult to find a Disability attorney to handle your claim.
Now, individuals who have had to file for social security disability may find it hard to believe that there's anything fair or objective about the federal disability system, particularly if they ever had to appear before a rude or biased judge, had statements from their doctors ignored, or suffered financial ruin because of how long their case took.



Nonetheless, the federal system is decidedly more fair (versus filing for LTD benefits with an insurance company) and for this one simple reason: when it comes to SSD, the individual who decides the disability claim (a disability examiner or a disability judge) does not have a vested interest in the outcome of the case. In other words, the individual deciding the case does not stand to gain or lose money if the disability claim is approved or denied.

This is an important distinction to remember and it does not happen to be the case for long term disability claims. By contrast, each time the long term disability insurance company pays out on a long term disability claim, they lose money. And by the same token, the more LTD claims the company approves, the worse their bottom line ends up looking.

Succintly put, it is simply not in a company's financial interests to approve long term disability claims. And, not surprisingly, as a result, going up against an LTD insurer (i.e. filing an LTD claim) can be tremendously difficult...despite the fact that the individual filing for long term disability benefits is simply trying to collect what has been paid for in the form of premiums.

For this reason above all others, a person who is filing for LTD benefits, or even just thinking of initiating an LTD claim, should probably consider consulting with an experienced Disability Lawyer beforehand to strengthen their position, avoid mistakes, and preserve as many options as possible.
