I am in a serious situation. I stopped receiving my social security benefits recently. Yet, now, I find I can no longer work. Is it possible to speed up the process and expedited reinstatement of disability benefits?

Answer:

The Ticket to Work and Work Incentives Improvement Plan (TWWIIP) Act is responsible for the rules governing who can or cannot apply to receive an expedited reinstatement (EXR) of benefits. In order to apply, you must qualify under one of five conditions:

  • You no longer are receiving SSDI because of your work income
  • Your earnings do not meet the current standards of substantial gainful employment (SGA). This may because you have suffered a significant decrease in your income or have stopped working all together
  • Your impairment remains the same as or is related to that of your original claim for SSD
  • You are making the claim within the allotted time period – within five years from the month in which your SSD claim was terminated as a result of SGA
  • The Medical Improvement Review Standards (MIRS) still can determine you are actually disabled

A request for an EXR is usually one based on necessity. You will need to refile. It is important to include all relative information. You must provide supporting documents from employers and medical professionals. Supply information on your current income to show either a decrease in your earnings or the lack of same. You should then receive provisional benefits for six months while they determine your claim’s merits.
