If you, as a claimant for either social security disability (ssd) or supplemental security income (ssi) benefits, are unhappy or unsatisfied with the representation you are currently receiving from either your non attorney representative or disability lawyer...simply find someone else to take your case. The social security administration will not penalize you in any way for changing from one representative to another, no matter what level in the social security disability process your case is at. How do you switch from one representative to another? First of all , before switching you should probably contact the office of your current representative and have them respond to your concerns. In many instances, it may turn out to be the case that adequate representation was, in fact, being delivered , but, due to poor communication, the claimant was simply unaware of this. Here's an example. Many claimants will question why it is that they seldom hear from their lawyer or non attorney rep. But there's a very reason as to why a claimant may not hear from their rep as often as they would like. And that reason is this: after an appeal has been submitted, there is really little for a representative to do other than to wait for the social security administration's response. The social security disability system is like that, though. Paperwork is filed...and then you wait, often for many months. Usually, there is little that any representative, attorney or otherwise, can do about this. However, a claimant who is absolutely certain that a change regarding their representation should be made should simply 1. find a new advocate 2. sign the necessary paperwork with the new advocate (who will notify SSA that a change has been made by sumitting a new form ssa-1696 to the social security office) and 3. notify the former advocate that their services are no longer required.
