SHOULD YOU GET A SOCIAL SECURITY DISABILITY ATTORNEY BEFORE YOU ARE DENIED?

This information may help claimants with representation, as well as claimants who are not represented by an attorney or non attorney representative. Understanding how the Social Security Disability system works can make the difference between winning or not winning the continuing ssd or ssi disability benefits and backpay to which a person is entitled.

As to whether or not a claimant should retain an ssd lawyer or non attorney representative prior to receiving a denial, this may depend on the claimant's comfort level with the social security disability process.

Some claimants will do better by having an advocate involved in their case as early as possible. But this is not a necessity by any means.

However, claimants should probably bear in mind this fact: if an ssd or ssi disability claim is denied at the intial (i.e. application) level, it may be prudent to seek representation since the likelihood is that, to be awarded benefits, the claimant will have pursue the claim at least as far as the disability hearing stage.
